Mandates in Football: Are They Valid Under FIFA Regulations?

Mandates have long been a part of football transfers, but under FIFA’s latest regulations, their legal standing is unclear at best and non-existent at worst. Personally, in a final, last chance gamble to get a deal done would I agree to work under a mandate. It wouldn’t exicte me, and I would have little confidence the deal would get finalised.

But….

Surpisingly, many agents and intermediaries rely on mandates to do business, but are they actually valid?

What Is a Mandate?

A mandate is an informal agreement that gives someone the authority to negotiate a transfer or contract on behalf of a player or club.

There are two main types:

1. Club Mandate – A club authorises an agent or intermediary to find a buyer for a player.
2. Player Mandate – A player gives an agent permission to negotiate with clubs.

Mandates are typically non-exclusive (and non-enforceable), meaning multiple agents may be working on the same deal. They are also short-term and can often be cancelled at any time.

Are Mandates Recognised by FIFA?

No! And it’s pretty clear…

FIFA does not recognise mandates under the FIFA Football Agent Regulations (FFAR).

FIFA only recognises written representation agreements between a FIFA-licensed agent and a player or club.

These agreements must be:

• Signed by both parties
• Clearly define the terms of representation as defined in the FFAR
• Registered FIFA Licensed Football Agent

If a dispute arises, FIFA will only consider registered representation agreements—not mandates.

The Risks of Mandates

Mandates might seem like an easy way to get involved in transfers, but they come with major risks:

1. No Legal Standing
Since FIFA does not recognise mandates, they offer no legal protection. If a deal happens and you’re left out, you have no FIFA-backed claim to payment. You’re essentially screwed!

2. Multiple Agents, Same Deal
Because mandates are often non-exclusive, multiple agents may present the same player to the same club, leading to confusion, frustration, and a loss of credibility.

3. No Guaranteed Commission
Without a registered representation agreement, clubs or players can cut you out of a deal and refuse to pay your commission. Again you’re screwed…

4. Potential FIFA Violations
Under FIFA’s new rules, only licensed agents can represent players and clubs. Acting under a mandate without a FIFA Football Agent license could be considered an unauthorised practice, putting you at risk of sanctions. 

Why Do Mandates Still Exist?

Despite the risks, mandates continue to be used in football. Here’s why:

• Clubs want multiple options – Some clubs prefer to work with multiple agents to find the best deal.
• Agents without representation agreements – Many agents struggle to sign official agreements with players or clubs, so they use mandates instead.
• Lack of knowledge – Some people in football don’t fully understand FIFA’s regulations and assume mandates are valid.
• Unlicensed intermediaries – Many unlicensed individuals operate in football’s grey areas, using mandates to work around FIFA’s rules.

The Right Way to Operate Under FIFA’s Rules

If you’re serious about being a football agent, you need to work within FIFA’s regulations

Get a FIFA Football Agent license – Without it, you can’t legally represent players or clubs.

Sign proper representation agreements – These ensure your rights are protected and you get paid.

Register agreements with FIFA – When FIFA or the relevant national associatio allow you to do so, register the agreements. This will increase you legal standing in case of disputes.

Final Thoughts

Mandates may still be common in football, but they are not legally valid under FIFA’s regulations. If you want to build a career as an agent, you must operate with official representation agreements and stay within FIFA’s framework.

It baffles me why Licensed Football Agents would choose work with an agreement which is essentially worthless and potentially damaging to your business.
